Exercising One Right Does Not Void The Other. The Second Amendment protects the right of the people to keep and bear arms. The Fourth Amendment protects the right of the people to be secure against unreasonable searches and seizures. Lawfully carrying a firearm is not Reasonable Suspicion for a Terry Stop. Open Carry is not Reasonable Suspicion for a Terry Stop. United States Court of Appeals for the Fourth Circuit - where a state permits individuals to openly carry firearms, the exercise of this right, without more, cannot justify an investigatory detention.
